Terms of Service

These terms cover your use of rolume.com, the Rolume receptionist service and the client portal. "Rolume", "we" and "us" mean the business that provides the service. "You" means the business that signs up, and the person who agrees for it. The account owner agrees to these terms for the business by signing a service order online or by ticking the box before paying in the portal. If you signed a separate service agreement with Rolume, that agreement controls wherever it differs from these terms.

What Rolume does

Rolume answers incoming phone calls for your business with an AI receptionist, collects job details from callers, books visits inside the hours and arrival windows you set, texts your customers a confirmation and a review request once texting is set up for your number, and shows you the calls, bookings and texts in a portal. Rolume does not make outbound calls to your customers or leads.

The receptionist answers in your business's name. It never claims to be a person, and if a caller asks, it tells them it is an AI assistant.

Your responsibilities

Not an emergency service

Rolume is not an emergency service and cannot dispatch emergency responders. Callers with a fire, a gas leak, carbon monoxide or any other danger to life or property should hang up and call 911 or their utility's emergency line. You are responsible for how your business handles urgent calls.

Accuracy and availability

The receptionist is automated. It can mishear a name, an address or a time, and it can occasionally be unavailable because of a phone carrier, internet or provider outage. We work to keep the service accurate and running, and the portal lets you listen to every call and flag one that went wrong, but we do not guarantee that every call will be answered or every detail captured correctly.

Your data

Your call recordings, transcripts, texts and customer details are yours. We handle them on your behalf, only to provide the service to you, as described in our Privacy Policy, and we do not sell them. We keep them confidential, protect them with reasonable security, and tell you without unreasonable delay if we learn they were accessed without permission. You can ask us to export or delete them at any time.

Acceptable use

Do not use Rolume for unlawful calls or texts, to harass anyone, to send marketing texts, or to try to access another client's account or data.

Ending service

You can cancel at any time in the portal or by telling us in writing, including by email. A monthly plan ends at the end of the plan month you have paid for. A yearly plan ends at the end of the paid year unless you get a refund under the next section. We may suspend or end service for non-payment or for breaking these terms.

When service ends, we turn off your receptionist, and you should stop forwarding your calls to it. Within 30 days you can ask us to export your call recordings, transcripts and bookings. After that we delete them within 90 days of the day service ended, except anything the law requires us to keep, such as billing records.

Refunds

Disclaimers and limits

The service is provided as is, without warranties of any kind beyond those that cannot be excluded by law. To the extent the law allows, Rolume is not liable for lost profits, lost business or indirect damages, including from a missed, misheard or mis-booked call, and our total liability for any claim is limited to the fees you paid us in the three months before the claim arose.

Covering each other

You will defend and cover Rolume against claims, fines and reasonable legal costs that come from your business's work, from information you gave us that was wrong, from your business forwarding or recording calls where it wasn't allowed to, or from texts sent at your request to someone who had not given you their number or had asked you to stop. Rolume will do the same for you for claims that come from Rolume breaking the law or these terms, including texts sent to someone on your no-text list. The side asking for cover will tell the other side promptly and let them handle the claim.

Changes to these terms

We may update these terms. We will post the new version here with a new effective date and tell clients at least 30 days before a significant change takes effect. If you don't agree to it, you can cancel before it starts.

Governing law

These terms are governed by the laws of the State of Colorado. Any court case about them will be brought in the state or federal courts in Colorado.
